Off-duty ECSO Deputy will not face charges for March 22nd shooting at Red Rose Gentlemen Club

Bill Eddins, State Attorney for the First Judicial Circuit, announced Tuesday, August 16, 2016 that Sardor Pulatov, an Escambia County Sheriff’s Office Deputy, will not be charged in the March 22, 2016 shooting of Dustin Jones and Kyle Parker. Jones died as a result of his gunshot wound. The incident occurred after an altercation outside the Red Rose Gentlemen’s Club on Okaloosa Island at approximately 4:45 a.m. that March morning.

According to the investigation conducted by the Okaloosa County Sheriff’s Office, Pulatov had worked an off-duty detail earlier in the evening on March 22, 2016 which he completed at 11:00 p.m. After completing the detail he traveled to Okaloosa County to meet some friends for the evening. The group moved to several different bars throughout the early morning hours. During that time, Adrian Toderas befriended Chance and Maryna Shaw, who joined the group. After going to several clubs they ended up at the Red Rose Gentlemen’s Club.

During this same time frame, Kyle Parker and his roommate, Joseph Wagner, were out celebrating Parker’s release from jail that day. They visited several bars in the Destin area and eventually arrived at the Red Rose Gentlemen’s Club at approximately 2:00 a.m. where they remained until closing.

During this same time frame, Dustin Jones and his girlfriend were out drinking at several different establishments in Fort Walton Beach and Valparaiso until 2:00 a.m. They went home, where Jones remained until being convinced by his friend, Dave Lee Carty, to come and meet him as the Red Rose Gentlemen’s Club. Jones arrived at around 3:40 a.m.

At approximately 4:40 a.m. the Red Rose Gentleman’s Club was closing and the individuals all started to leave the club. Once outside, near the door, a confrontation occurred between Chance Shaw and Adrian Toderas. Shaw believed Toderas had insulted him by making improper comments to his wife earlier. As the confrontation escalated, Sardor Pulatov, Dmitri Macarenco and Vladislav Morozov got out of Pulatov’s vehicle and approached Chance Shaw, Toderas and Maryna Shaw. Pulatov identified himself as a deputy sheriff and showed his Escambia County Sheriff’s Office badge. He told everyone to calm down. Chance Shaw, feeling threatened, punched Pulatov, Macarenco and Morozov in the faces and took off running. Macarenco and Morozov then chased after Shaw. Pulatov returned to his car and attempted to find them. Toderas also got in his vehicle and attempted to locate them.

There were numerous varying accounts of where people were and what actions they took during this time. Eventually, Shaw ran across Santa Rosa Blvd. towards the Waterscape Condominiums and attempted entry but the doors were locked and kept on running. The security guard came out and made contact with Pulatov who had parked his car in the Waterscape parking lot. Pulatov indicated that no help was needed.

Pulatov stated that he looked and saw a group of people coming across the street towards him. Pulatov gave several statements that vary, but has consistent that one of the individuals had  what appeared to be a large knife. Pulatov stated he was in fear so he ran to his vehicle in the Waterscape parking lot to retrieve his firearm. Testimony from several witnesses indicate that at this time, Kyle Parker, Joseph Wagner, Dustin Jones, Dave Carty and Lucas Simpliciano begin to approach Pulatov at his car. Pulatov stated the group was yelling at him but was not sure what was being said. Testimony was given that Dustin Jones and Joseph Wagner were holding up a cellphone, appearing to record Pulatov.

When the the group of Pulatov, within 5-6 feet, Pulatov pulled out his weapon and told everyone he was a cop and he would shoot them if he had to. Dustin Jones stated at that time that Pulatov wasn’t going to shoot him. Pulatov stated that Jones said “I’ve got you backed in a corner now, bitch, what are you going to do?” Kyle parker came up behind Pulatov and struck him. Pulatov’s firearm discharged twice, striking him in his right arm. Both bullets passed through Pulatov’s right arm. One bullet struck Dustin Shaw in the chest and the other struck Kyle parker in the leg. Dustin Jones ran back across the street and collapsed near the entrance to the Red Rose Gentleman’s Club. Kyle parker fell to the ground and remained there until law enforcement arrived. During Kyle Parker’s interview, he stated, “If I hadn’t hit him, no one would have been shot.”

Dustin Jones died as a result of the gunshot wound several hours later at a local hospital. Kyle parker was treated and released for his leg wound.

The report concluded that based upon a totality of the facts and circumstances, Sardor Pulatov was justified in arming himself and protecting himself from the group surrounding him. Kyle parker’s actions caused the firearm to be discharged when he attacked Sardor Pulatov from behind.  Therefor there is insufficient evidence to prove beyond a reasonable doubt that Sardor Pulatov committed any crime when he shot Dustin Jones and Kyle parker and no criminal charges should be filed against Sardor Pulatov.
